Terms and Conditions

As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with.

*Payment for any policy offered by Secure Home is considered the purchaser's formal acknowledgement of the terms and conditions herein*

Application

  1. These Terms and Conditions will apply to home warranty services provided only and should not be confused with an insurance contract by you (the Customer or you).
  2. We are Secure Home Warranty hereinafter referred to as Secure Home (or Company or us or we).
  3. These are the terms on which we sell all Service to you, Whereas, your home warranty coverage remains with the home covered and cannot be transferred to a different home; Whereas, Secure Home is obliged to cover household appliances and systems when they become inoperable due to normal wear and tear; Whereas, this Agreement sets forth all of the household appliances and systems covered under this Agreement and the specific items that are excluded from coverage. In the event an appliance or system is not mentioned in this Agreement, it will not be covered under this Agreement. You hereof, agree to be bound by these Terms and Conditions.

Interpretation

  1. Consumer means an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession;
  2. Contract means the legally-binding agreement between you and us for the supply of the Services;
  3. Services means the services, for the number and description set out in the Order.

Services

  1. The description of the Services is set out that Secure Home will arrange for a licensed contractor and/or specialist ("Contractor") to repair or replace the systems and appliances covered under this Agreement, when they become inoperable due to normal wear and tear.
  2. In the case of Services and any Goods made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.
  3. All Services are subject to availability.
  4. We can make changes to the Services, which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.

Customer responsibilities

  1. You must co-operate with us in all matters relating to the Services, provide us and our authorized Contractor and representatives with access to any premises under your control as required, provide us with all information required to perform the Services and obtain any necessary licenses and consents (unless otherwise agreed).
  2. You further understand that, we only cover systems and appliances that are located in a single-family residence, individual condominium units, town houses and modular homes. Only those systems and appliances properly and permanently installed and located within the living area of the home will be covered. This Agreement will not cover systems or appliances within (i) commercial properties; (ii) residential properties used for business purposes, including, but not limited to, residences used for rest homes, day care centers, schools and/or professional offices; and (iii) common areas of condominiums, multi-family houses and/or co-ops (IV)foreclosed/short sale. This Agreement will not cover any system or appliance selected by the manufacturer as being used for commercial use.
  3. The inability to conform to Terms stated would result in a Client default, which entitles us to suspend performance of the Services until you remedy it or if you fail to remedy it following our request, we can terminate the Contract with immediate effect on written notice to you.

Governing law, jurisdiction and complaints

  1. The Contract is governed by the law of the State of Pennsylvania. Disputes can be submitted to the jurisdiction of the courts within the State of Pennsylvania.

Basis of Sale

  1. The description of the Services and any Goods in our website, catalogues, brochures or other form of advertisement does not constitute a contractual offer to sell the Services or Goods.
  2. When an Order has been made, we can reject it for any reason, although we will try to tell you the reason without delay, which must be due to running out of stock or resources, a price or description mistake, inability to obtain your payment or other genuine and fair reason.
  3. A Contract will be formed for the Services ordered, only upon the Supplier's written acceptance of the Order or, if earlier, the Supplier's delivery of the Services to the Customer.
  4. Any quotation or estimate of Fees is valid for a maximum period of 3 days from its date, unless we expressly withdraw it at an earlier time.
  5. No variation of the Contract, whether about description of the Services, Fees or otherwise, can be made after it has been entered into unless the variation is agreed by the Customer and the Supplier in writing.

Claims

  1. Non-Emergency Claims. To report a claim for repair, you must contact Secure Home Warranty within 3 days following discovery of the malfunctioning and/or inoperability of the system or appliance. Please ensure that you: (i) Rapidly contact the proper authority in the event that an out of order appliance or system has the potential to cause injury to you or anyone else present in or in close proximity to you; (ii) Halt the malfunctioning appliance or system to prevent further damage; and (iii) Conclude if the malfunctioning appliance or system is covered under this Agreement.
  1. Emergency Claims. In the event of an emergency, in order for Secure to determine that the claim is covered, you must contact Secure Home Before having the repair or replacement performed. In the occasion, the crisis relates to gas, fire, or possible personal harm to yourself or any other person present in or close to your home promptly takes action, including, yet not constrained to: vacating the home, as a measure of safety precaution to you and those present. Once the determination is made by Secure that your house is safe to re-occupy, contact Secure right away to update your account.
  2. If Covered, If Secure Home is obliged to cover the malfunctioning appliance or system, you must contact Secure Home prior to obtaining service on the malfunctioning appliance or system. Your failure to contact Secure Home prior to obtaining service may render your claim invalid. Secure Home will not reimburse you if you use your own service technician without first obtaining Secure's prior authorization.
  3. Secure Home Service Call Fee/Deductible. Every time a Contractor is booked and dispatched to your home, you will be obligated to pay Secure Home Service Call Fee in the amount of seventy-five (75.00) dollars. You will be required to pay Secure Home Service Call Fee regardless of whether all or part of the claim is granted, excluded, limited or denied by Secure. You will be required to pay Secure Home Service Call Fee once the Contractor begins traveling to your home, regardless of whether you are able to provide access to your home for Contractor or if you cancel the appointment while the independent service Technician is traveling to your home, a separate service call fee will be charged for each issue. Extra charges may apply to Secure Home Service Call Fee. Secure Home Service Call Fee, which must be paid at the time and spot of arrangement, shall be paid by you to the independent service Technician or directly to Secure, at Secure's option. In the event you fail to pay Secure Home Service Call Fee, you will not be able to schedule any additional service calls and your home warranty coverage will be suspended until all outstanding fees are paid in full Suspension of your home guarantee scope won't modify or expand the Termination Date of your home guarantee scope.

Non-Emergency Claims. To file a claim for repair you must contact Secure within three (3) days of detecting a malfunctioning system or applianceThe technician is instructed to contact the homeowner within two (2) days during normal business hours, and four (4) days on weekends. If covered by this agreement, the system and/or appliance repaired or tradedwill be paid for by Secure, within a timely manner of a thirty (30) day period. Secure Home will not be responsible for any delay in parts or repair work due to backorder or manufacturer.

Duration, termination and suspension

  1. The term of your warranty coverage shall activate thirty days (30) days following Secure's receipt of all unsettled payments and premiums due to Secure Home are received by Secure Home ("Effective Date"); In the event Secure Home does not receive all outstanding payments and/or premiums outstanding and/or signed contract, for any reason, your warranty coverage term will not begin.
  2. Either you or we may terminate the Contract or suspend the Services at any time by a written notice of termination or suspension to the other if that other:
  3. commits a serious breach, or series of breaches resulting in a serious breach, of the Contract and the breach either cannot be fixed or is not fixed within 30 days of the written notice; or
  4. Is subject to any step towards its bankruptcy or liquidation.
  5. On termination of the Contract for any reason, any of our respective remaining rights and liabilities will not be affected.
  6. Your warranty coverage will begin on the Effective Date and remain in effect for one (1) calendar year following the Billing Date.
  7. Coverage waiting period may be expedited with proof of prior coverage's expiration date provided there was no break in coverage provided by us.
  8. Please add an additional 5 days for credit/debit card payments.

Successors and our sub-contractors

  1. Either party can transfer the benefit of this Contract to someone else, and will remain liable to the other for its obligations under the Contract. The Supplier will be liable for the acts of any sub-contractors who it chooses to help perform its duties.

Circumstances beyond the control of either party

  1. In the event of any failure by a party because of something beyond its reasonable control:
  2. the party will advise the other properly as soon as reasonably practicable; and
  3. the party's obligations will be extended so far as is reasonable, provided that that party will act reasonably, and the party will not be liable for any failure which it could not reasonably avoid, but this will not affect the Customer's above rights relating to delivery.

Excluding liability

  1. We exclude liability for: (i) any fraudulent act or omission; or (ii) death or personal injury caused by negligence or breach of the Supplier's other legal obligations. Subject to this, we are not liable for (i) loss which was not reasonably foreseeable to both parties at the time when the Contract was made, or (ii) loss (eg loss of profit) to your business, trade, craft or profession which would not be suffered by a Consumer - because we believe you are not buying the Services and Goods wholly or mainly for your business, trade, craft or profession.

Covered Systems and Appliances

  1. Appropriate Working Order. All systems and appliances must be in appropriate working order on the Effective Date of the service agreement, as put forward in the schedule page accompanying with this Agreement. Any prior conditions or deformities bringing on the breakdown of systems or appliances during the term will not be covered by this Agreement. If a damaged or breaking down system or appliance is found by an assessment organization prior to transfer of ownership of the property or by a service organization at the time of the exchange of ownership, said condition shall be deemed a prior condition and not covered under this Agreement.
  2. Manufacturer’s Warranty. All systems and appliances covered under either the manufacturers, distributors, or some other express or suggested guarantee will not be covered under this Agreement.
  3. Appliances Covered. Secure Home is obliged to cover the accompanying appliances:
    1. Clothes Washer/Clothes Dryer, Secure Home is obliged to cover all modules, components and parts of the clothes washer and clothes dryer necessary to the functionality of the clothes washer and clothes dryer. Secure Home shall not be obliged to under any circumstances cover any harm made to clothing as a consequence of being washed and/or dried by the covered clothes washer and/or clothes dryer. Secure Home shall not be obliged to under any circumstances cover the accompanying list of modules, components and parts identifying with the clothes washer and clothes dryer: (i) containers; (ii) stooped up channels; (iii) obstructed lines; (iv) Obstructed pipes and/or obstructed venting; (v) flush guides; (vi) drums/tubs.
    2. Refrigerator, Secure Home is obliged to cover one (1) refrigerator situated inside of the kitchen of the covered home. Secure Home is obliged to cover all modules, components and parts of the refrigerator necessary to the functionality of the refrigerator. Secure Home shall not be obliged to under any circumstances cover the accompanying list of modules, components and parts identifying with the refrigerator: (i) ice makers; (ii) ice crushers; (iii) dispensers; (iv) freezer parts and components which are not vital to the refrigerator unit as a whole (v) Refrigerant;(vi) Refrigerant leaks; (viii) damage brought about by Refrigerant leak; (ix) leaks; (x) sealed systems.
    3. Water Heater. Secure Home is obliged to cover all modules, components and parts of the water heater necessary to the functionality of the water radiator. Secure Home shall not be obliged to under any circumstances cover sun based or tank less water heating systems or the parts thereof. Secure Home shall not be obliged to under any circumstances cover the accompanying list of modules, components and parts identifying with the water heating systems: (i) vents; (ii) drain funneling; (iii) weight diminishing valve; (iv) leaks (v) pumps.
    4. Built-in Microwave, Secure Home is obliged to cover all modules, components and parts of built-in microwave necessary to the functionality of the built-in microwave. Secure Home shall not be obliged to under any circumstances cover portable, combo or ledge microwaves. Secure Home shall not be obliged to under any circumstances cover the accompanying list of modules, components and part identifying with the built-in microwave oven: (i) restorative issues or variations from the norm; and (ii) components identifying with establishment/mounting.
    5. Dishwasher, Secure Home is obliged to cover all modules, components and parts of the dishwasher necessary to the functionality of the dishwasher. Secure Home shall not be obliged to under any circumstances cover the accompanying list of modules, components and parts identifying with the dishwasher: (1) flush guides; (ii) obstructed channels; (iii) stooped up lines; (iv) framing and trim (v) latches.
    6. Oven/Range/Stove Top. Secure Home is obliged to cover all modules, components and parts of the gas or electric oven, range and stove top necessary to the functionality of the oven, range and/or stove top. Secure Home shall not be obliged to under any circumstances cover the accompanying list of modules, components and parts identifying with the oven range or stove top: (i) range hood; (ii) burner bowls and covers (iii) nonessential issues or variations from the norm (iv) frying pans.
    7. Garbage Disposal, Secure Home is obliged to cover all modules, components and parts of the garbage disposal necessary to the functionality of the garbage disposal. Secure Home shall not be obliged to under any circumstances cover typical and customary garbage disposal disappointments, for example, sticking and resetting. Secure Home shall not be obliged to under any circumstances cover the accompanying list of modules, components and parts identifying with the garbage disposal: (i) spines; (ii) rings (iii) components identifying with establishment/mounting (iv) trash compactor.
  4. Systems Covered. This understanding covers the accompanying systems:
    1. Plumbing Stoppages. Secure Home is obliged to cover stoppages in drain, vent and sewer lines up to 100 feet from access point, with the exception of if created by roots. Mainline stoppages are just cleared when there is an available ground level wipe out. Secure Home shall not be obliged to under any circumstances cover Stoppages brought about by collapsed, harmed or broken drain, vent or sewer lines outside the limitations of the establishment of the primary home. Stoppages due to roots or outside articles. On the off chance that the lines are broken or penetrated by roots or are generally halted by roots, regardless of the fact that the break, invasion or stoppage is inside of 100 feet from the entrance point, it is not covered.     2. Garage Door Opener. Secure Home is obliged to cover the following garage door opener components: (i) control board; (ii) motors; (iii) chains; (iv) belts; (v) gears; (vi) pulley; (vii) sheave fork; (viii) axle bolts; and (ix) switches. Secure Home shall not be obliged to under any circumstances cover the following list of modules, components and parts relating to the garage door opener system: (i) garage doors; (ii) locks; (iii) springs; (iv) adjustments; (v) brackets; (vi) rollers; (vii) hinges; (viii) glass paneling; (ix) knobs; (x) buttons; (xi) wall switches; (xii) lock cable; (xiii) tracks; (xiv) rails; (xv) drums; (xvi) light bulbs; (xvii) light coverings; (xviii) mounting equipment and components; and (xix) alarm system components.
    3. Plumbing System. Secure Home is obliged to cover the accompanying plumbing system components: (i) line leaks in water, drain, waste or vent lines not brought about by harm due to freezing or from roots; (ii) line breaks in water, drain, waste or vent lines not created by harm due to freezing or from roots; (iii) toilet tanks; (iv) toilet flushing systems; (v) angle stops; (vi) risers; Secure Home shall not be obliged to under any circumstances cover the accompanying list of modules, components and parts identifying with the plumbing system: (i) tub and shower base pans; (ii) line leaks/breaks/stoppages due to freezing, root harm or remote items; (iii) line leaks/breaks/stoppages created by collapsed, harmed or broken drain, vent or sewer lines outside the primary establishment of the covered home; (iv) access to drain or sewer lines out of the vent or evacuation of the water storage room; (v), water softeners; (vi) lacking or unreasonable water weight (vii) plumbing components identifying with hose tuckers (viii) lead channel lines/funnels; (ix) slab leaks (x) tub and shower valves(xi) cartridge (xii) pumps (xiii) jetting.
    4. Air Conditioning (Central). Secure Home is obliged to cover the primary floor air conditioning unit of the covered home only, provided that the air conditioning unit does not exceed a five (5) ton capacity. Secure Home is obliged to cover the following air conditioning components: (i) motors; (ii) compressors; (iii) condensers; and (iv) thermostats. Secure Home shall not be obliged to under any circumstances cover window, wall or zone systems or portable air conditioning units. Secure Home shall not be obliged to under any circumstances cover (i) air filters; (ii) Refrigerant; (iii) Refrigerant recapture; (iv) geothermal systems; (v) gas or propane air condition systems; (vi) air filtration systems; (vii) humidifiers; (viii) registers; (ix) grills; (x) stands; (xi) jacks; (xii) condenser casings; (xiii) pads; (xiv) vents; (xv) flues; (xvi) clogged lines; (xvii) condensation leaks; (xviii) mismatched systems; (xix) damaged ducts; (xx) improper wiring; and (xxi) improper piping (xxii) Refrigerant leaks;(xxiii) damage caused by Refrigerant leak.
    5. Heating System (Primary Only). Secure Home is obliged to cover all module, components and parts of the heating system necessary to the functionality of the heating system Secure Home is obliged to cover the essential heating arrangement of the covered home just, gave that the heating systems do not surpass a five (5) ton limit. Secure Home shall not be obliged to under any circumstances cover sun powered heating systems or the components thereof. Secure Home shall not be obliged to under any circumstances cover any convenient heating units or zone systems or divider units or components thereof. Secure Home shall not be obliged to under any circumstances cover chimneys or warmth lights or the components thereof. Secure Home shall not be obliged to under any circumstances cover brilliant heating systems incorporated with dividers, roofs or floors. Secure Home shall not be obliged to under any circumstances cover the accompanying list of modules, components and parts identifying with the heating systems: (i) wiring; (ii) air cleaners; (iii) obstructed lines; (iv) pipes; (v) heat exchanger; (vi) damper engines; (vii) humidifiers; (viii) timekeepers and clocks; (ix) curls; (x) pipe perplexes; (xi) channeling; (xii) geothermal heating/cooling units; (xiii) fire box; (xiv) valves; and (xv) water funneling.
    6. Electrical System. Secure Home is obliged to cover the following electrical system components: (i) junction boxes; (ii) service panels; (iii) breakers sub-panels (iv) switches; (v) breakers; (vi) outlets; (vii) wiring; (viii) ground fault interrupters; Secure Home shall not be obliged to under any circumstances cover damage to the electrical system caused by flood, fire, water, rust, corrosion and lightni Secure Home shall not be obliged to under any circumstances cover the following list of modules, components and parts relating to the electrical system: (i) alarm equipment; (ii) fixtures; (iii) doorbells; (iv) intercom equipment; (v) inadequate wiring capacity; (vi) damage caused by double or triple tapping; (vii) wire tracing; (viii) damage caused by a power failure; (ix) damage caused by a power failure(x) attic fans.
    7. Ceiling Fan, Secure Home is obliged to cover all modules, components and parts of ceiling fan affixed in the covered home necessary to its functionality. Secure Home shall not be obliged to under any circumstances cover (i) lights.
    8. Ductwork. Secure Home is obliged to cover all ducts from heating and/or cooling unit to the point of attachment at registers or grills. Secure Home shall not be obliged to under any circumstances cover the following list of modules, components and parts relating to the duct system: (i) improperly sized ductwork/duct system; (ii) registers; (iii) insulation; (iv) dampers; (v) panels; (vi) regulators; (vii) crushed ductwork; (viii) diffusers; (ix) flue ducts; (x) ductwork insulated by asbestos; (xi) boxes; (xii) crushed ductwork; and (xiii) grills.
  5. Additional Coverage Options. The following is a list of covered systems and appliances which you have the option to purchase from Secure. The following components will only be covered if you advise Secure Home that you wish to add the additional home warranty coverage and Secure Home is in receipt of the additional payment for said coverage. You may purchase the additional for up to thirty (30) days following the Purchase Date of the home warranty coverage but coverage for the additional coverage option will not take effect until payment is received by Secure Home for the additional coverage and the addition coverage will terminate on the Termination Date.
    1. Septic System Coverage. Aerobic pump, sewage ejector, jet pump, septic tank. Secure Home shall not be obliged to under any circumstances cover Tile fields and leach beds, leach lines, lateral lines, insufficient capacity, clean out, pumping.
    2. Well Pump. Secure Home is obliged to cover all components of well pump, provided the well is the primary water source to the covered home. Secure Home shall not be obliged to under any circumstances cover the following list of modules, components and parts relating to the well pump: (i) well casings; (ii) holding and storage tanks; (iii) piping or electrical lines leading to or connecting pressure tank and covered home; (iv) re-drilling of wells; (v) booster pumps; and (vi) components for geothermal/heat pumps.
    3. Roof Leak. This shall only apply in cases where roof leak repairs over active area of single family homes only. Secure Home is obliged to cover the roof leaks only. Secure Home shall not be obliged to under any circumstances cover the following list of modules, components and parts relating to roof leaks: (i) patios; (ii) porches, (iii) decks; (iv) metal roofs; (v) foam roofs; (vi) shingles; (vii) cemwood shakes; (viii) cracked and/or missing material; (ix) tiles; (x) tar and gravel; (xi) flat or built-up roofs; (xii) structural leaks; (xiii) asphalt; (xiv) gutters; (xv) downspouts; (xvi) skylights; (xvii) flashing; (xviii) patio covers; (xix) solar components; (xx) attic vents; (xxi) roof jacks; (xxii) satellite components; (xxiii) antennae; and (xxiv) chimney component Secure Home shall not be obliged to under any circumstances cover repairs requiring partial or complete replacement of roofs.
    4. Plumbing and Lighting Fixtures. Secure Home is obliged to cover the following list of components: (i) faucets, (ii) showers heads, (iii) shower arm, (iv) and electrical switches. Secure Home shall not be obliged to cover: (i) Florescent fixtures, (ii) Dials, (iii) Knobs, (iv) Filters, (v) and Diverters.
    5. Pool/Spa Equipment. This Agreement applies to the following list of pool/spa components: (i) pumping system; (ii) filtration system; (iii) heating system. Secure Home is obliged to cover the pool and/or hot tub or spa if they use common equipment. In the event the pool and spa or hot tub does not use the common equipment, then only one will be covere Secure Home shall not be obliged to under any circumstances cover portable pools, spas or hot tubs. Secure Home shall not be obliged to under any circumstances cover the following list of modules, components and parts relating to the pool/spa: (i) pool sweep motors; (ii) lights; (iii) liners; (iv) structural defects; (v) solar equipment; (vi) jets; (vii) control switches; (viii) computerized control boards; (ix) ornamental fountains, waterfalls and their components; (x) pool covers; (xi) fill line and fill valve; (xii) built-in or detachable cleaning equipment including, but not limited to, pool sweeps, pop up heads, turbo valves; (xiii) pool chemicals; (xiv) skimmers; (xv) chlorinators; (xvi) fuel storage tanks; (xvii) heat pumps; (xviii) ionizers; and (xix) disposable filtration components; (xx) portable spa; (xxi)above ground pool/spa, (xxii)plumbing.
    6. Stand Alone Freezer. Secure Home is obliged to cover all modules, components and parts of a standalone freezer necessary to its functionality. Secure Home shall not be obliged to under any circumstances cover the following list of modules, components and parts relating to the stand alone freezer: (i) glass displays; (ii) light bulbs; (iii) knobs and caps; (iv) dials; (v) door seals; (vi) gaskets; (vii) door hinges; (viii) door handles; (ix) shelves; (x) condensation pans; (xi) leveling feet; (xii) clogged drains; (xiii) clogged lines; (xiv) grates; (xv) ice makers; (xvi) ice crushers; (xvii) beverage dispensers; (xviii) thermal shells; and (xix) cosmetic issues or abnormalities.
    7. Central Vacuum. Secure Home is obliged to cover all modules, components and parts of central vacuum system necessary to its functionality. Secure Home shall not be obliged to under any circumstances cover the following list of modules, components and parts relating to the central vacuum system: (i) vacuum nozzles; (ii) clogged pipes; (iii) hoses; and (iv) vacuum accessorie
    8. Second Refrigerator. Secure Home is obliged to cover all modules, components and parts of a second refrigerator necessary to its functionality. Secure Home shall not be obliged to under any circumstances cover the following list of modules, components and parts relating to the refrigerator: (i) ice makers; (ii) ice crushers; (iii) beverage dispensers; (iv) freezer parts and components which are not essential to the refrigerator unit as a whole (v) Refrigerant damage caused by Refrigerant leak.
    9. Sump Pump Secure Home is obliged to cover all components of sump pump for ground water, provided the pump is within the foundation of the covered home. Secure Home shall not be obliged to under any circumstances cover the following list of modules, components and parts relating to the sump pump: (i) portable pumps; and (ii) sewer ejector pumps.
    10. Refrigerator's Ice Maker. Secure Home is obliged to cover all components and parts and shall exclude the following: (i) Standalone ice maker, (ii) dispenser (iii) valves (iv) water line.
    11. Lawn Sprinkler System. Secure Home is obliged to cover all mechanical components that affect operatio Secure Home shall not be obliged to under any circumstances cover Hydraulic Systems-Systems related to fire Extinguishing-Malfunctioning due to lack of water pressure- Batteries- Drip Irrigation Systems-Damage due to freezing, pets, cars, or lawn care equipment, heads.

Secure Home’s Contractors

  1. Secure’s Contractors have the required directive, once given to perform the any allowed repair and/or replacement services that are needed. Please be advised that Secure Home shall not compensate you for any problems encountered for any repair and/or replacement services done or attempted by Contractor, who was not authorized by Secure. If you experience any difficulties or have any disputes with a Contractor, please contact Secure Home immediately.

Secure Home’s Obligation

  1. Secure Home shall be obligated on Secure’s mandate to have the rights to:
    1. Secure Home’s Contractor to complete repair and/or replacement services;
    2. Obtain a second opinion with regard to the cost of replacement without any additional cost to you.
    3. In the event a covered system or appliance is deemed irreparable or it is not cost effective to repair, Secure Home may replace the system or appliance with a system or appliance of like capacity, the price of which shall not exceed the depreciated value of the system or appliance being replaced;
    4. For the replacement of a system or appliance that cannot be repaired to working order or it is not cost effective to repair; shall ultimately be Secure Home’s decision on the result, as Secure Home may choose to pay cash settlement for the irreparable component of the system or appliance. Secure Home will not however be responsible for installation services. The cash settlement shall be in an amount not to exceed the depreciated value of the component/appliance being replaced;
    5. Secure Home’s manufacturers make and model of any replacement parts used in the repair of the defective system or appliance; and omitted from Secure Home’s coverage.

Omitted from Secure Home’s Coverage

  1. Secure Home wishes to state the following list of systems and/or appliances that Secure Home are not obliged to cover under any circumstance.
    1. Force Majeure. Secure Home is not obliged to cover systems or appliances that require repair or replacement as a result of an Act of Nature, including, but not limited to, storms, earthquake, war, riot, fire, flood, mold, nuclear incidents, vandalism, pests, pets, freezing damage, theft, roots and settlement of earth.
    2. Dangerous Substances. Secure Home is not obliged to cover any systems, appliances and/or services relating to hazardous or toxic material including, but not limited to, acids, asbestos, lead and lead based products and any other hazardous contaminants.
    3. Foundation/Structure. Secure Home is not obliged to cover any damage and/or defects to the structural components of the covered home, including, but not limited to, the foundation and any beams of the covered home.
    4. Secure Home is not obliged to cover any systems or appliances that have had prior repair or that require repair or replacement as a result of improper installation, previous repair, damage caused by any construction activity, improper wiring, inadequate or lack of capacity, power failures, power surges, overloads, missing parts, failure to properly maintain, failure to properly clean, neglect, misuse, corrosion, rust, sediment and any modification to the system or appliance. You are solely accountable for providing upkeep once a year and cleaning from a registered professional authorized to perform such tasks on covered items to safeguard continued coverage on such items. Secure Home reserves the right to request prior years (3) upkeep records and/or other methods of evidence, without proper upkeep records and pictures the maximum payout on any system/appliance is up to $150.00. For instance: heating and a/c systems require periodic cleaning and/or replacement of filters and cleaning of evaporator and condenser coils. Water heaters require periodic flushing. This policy covers mechanical breakdowns, it does not cover maintenance, shelves, door handles, doors, hinges, knobs and buttons, door seals, displays, latches, timers, leveling equipment, clogged drains or lines, cosmetic issues, gaskets, leak searches, camera inspections, lights, noise, refrigerants, coils, valves, leaks (non plumbing), dispensers, installation, bearings, upgrades, and electrical failures.
    5. Solar/Smart House. Secure Home is not obliged to cover any systems, appliances, equipment and components, utilized in connection with solar heating or solar power systems. Secure Home is not obliged to cover electronic, computerized or energy management systems or devices, lighting and appliance management systems.
    6. Manufacturer's Defect. Secure Home is not obliged to cover any system or appliance that has malfunctioned as a result of the manufacturer's defect, recall and/or defective materials or parts.

Termination of Agreement by Secure Home

  1. Secure Home reserves the right to cancel this Agreement, therefore voiding this agreement in the event that you have: (i) involved in fraudulent activities (ii) make any misrepresentations (iii) fail to make the require payments to Secure Home (iv) agree to a mutual agreement to termination this Agreement between you and Secure Home. In the event Secure Home agrees to cancel this Agreement after a 30-day period; You shall be entitled to a pro rata refund of payments for the remaining term of the Coverage, this refund will be deducted by administrative fees and any service costs incurred by Secure Home; and you receive a refund pro-rated at the non-discounted annual plan cost.
  2. Secure Home reserves the right to terminate this agreement at any time at the sole discretion of Secure Home.

Termination of Agreement by You

  1. If you desire to cancel this Agreement within thirty (30) days of this Agreement, as set forth on the schedule page accompanying this Agreement, you shall be entitled to a full refund in the event that no service has been provided under the contract. After the thirtieth day, you may receive a refund pro-rated at the non-discounted annual plan cost. A $75.00 cancellation fee will be charged and any service costs incurred by Secure Home Warranty.

Renewal

  1. Should you desire to renew the Coverage for an additional period, as set forth in the schedule page attached to this Agreement, you must first contact a Secure Home representative prior to the expiration of your current term. Thereafter, you will be advised by a Secure Home representative pertaining to the new rates and the new terms of coverage. Secure Home shall ultimately reserve the right to deny your request for renewal for any reason and change the rate and terms of coverage for the renewed term.
  2. Automatic Renewal. In the event You select the monthly payment option and Secure Home opt to renew your contract, Secure Home will notify you of the rate and term for the renewal period during the tenth month of Your contract and You will be automatically renewed for an annual coverage period unless you notify Secure in writing thirty (30) days prior to the Termination Date. Please note that the initial fee paid for renewal will be considered as a sanction for another 12 Coverage period.

Secure’s Liability Provision

  1. Delay. Secure Home shall not be liable and must be held unaccountable for delays in repairing or replacing a system or appliance resulting from events beyond its control, including, but not limited to, weather conditions, labor disputes, strikes, delivery problems, war or availability of parts.
  2. Local/State/Federal Government Violation. Secure Home shall not be liable and must be held unaccountable for all repair or replacement of any system or appliance that would result in a violation of any local, state and/or federal laws, rules, codes or regulations. If a system or appliance cannot be repaired or replaced without violating a local, state or federal law, rule, code or regulation, then Secure Home's liability will be limited to providing you with a cash settlement. That would ultimately be in an amount not exceeding the depreciated cost of the product that requires repair or replacement. If a violation of any local, state and/or federal law, rule, code or regulation is discovered before or during the repair or replacement service, Secure Home will not be required to initiate and/or complete the repair or replacement service until the violation and/or possible violation is corrected by you. Secure Home shall not be liable and must be held unaccountable for any additional costs associated with the correction of the violation and/or potential violation. Secure Home shall not be liable and must be held unaccountable for any improvements, services and/or costs required to comply with any local, state and/or federal laws, regulations, ordinances.
  3. Proportions, Make and Color, Parameters. Secure Home shall not be liable and must be held unaccountable for matching a system or appliance’s color, brand, or dimensions and only is responsible for repairing and/or replacing systems or appliances of similar capacity and efficiency. Secure Home desires to publish this guideline that will be implemented to provide a repair/replacement stipend. For heating or cooling equipment (hvac), within the first 3 months of coverage (“Coverage Period”) a $500 repair/replacement allowance will be paid to the customer. This repair/replacement allowance will increase to $2000 after the Coverage Period. For appliances, plumbing and electrical (non-heating or cooling) in the first three months a $150 repair/replacement allowance will be paid to the customer. This repair/replacement allowance will increase to $500 after the first three months of coverage. For the Built-in Microwave in the first three months of coverage a $125 repair/replacement allowance will be paid to the customer. This repair/replacement allowance (for the built in microwave) will increase to $250 after the first three months of coverage. For additional coverage options in the first three months a $150 repair/replacement allowance will be paid to the customer. This repair/replacement allowance will increase to $400 after the first three months of coverage. In the event a part is not available, Secure Home's obligation shall be to reimburse for the value of the part up to the policy limits. If Refrigerant coverage is covered as an option, the limit is $150 for Coverage Period and $250 for the remainder of the contract.
  4. Elimination/Clearance. Secure Home shall not be liable and must be held unaccountable for any costs associated with the removal and/or elimination of any system and/or appliances repaired, or any waste or debris associated with the repair and/or replacement services.
  5. Upgrades. Secure Home is not obliged to cover upgrades to any system or appliance.
  6. Right of Entry. You must permit access to the system or appliance in need of repair or replacement. In the event that the system or appliance cannot be accessed without causing damage to a wall, floor, cabinet or ceiling, Secure Home must be held unaccountable and must be held harmless for any damages to: wall coverings, floor coverings, cabinets, counter tops, tiling, paint, or for the repair of any structural or cosmetic defects, including, but not limited to, reconfiguring space to accommodate replacement components.
  7. Consequential Damages. Secure Home is not obliged to provide coverage for loss caused by a malfunctioning or inoperable appliance or system that is as follows but is not limited to: water, fire and mold spores. Secure Home, its associates, contractor shall in no way be held accountable for any damages incurred, for any out of order or inoperable appliance or system.
  8. Hold Harmless. You shall keep, save and hold harmless Secure from any and all damages and liability arising out of any fault or negligence by you or any failure on your part to comply with any of the covenants, terms and conditions herein contained. In case Secure shall, without fault on its part, be made a party to any litigation commenced by or against You, you shall protect and hold Secure harmless and shall pay all costs, expenses and reasonable attorneys' fees
  9. Change to Terms of Service. Secure Home Warranty reserves the right to revise Terms of Service at any time and any changes to these Terms of Service.
  10. Incurred or paid by Secure Home, in connection with such litigation or in enforcing the covenants and terms stated throughout this Agreement. We are not liable for the negligence or other conduct of the Service Provider, nor are we an insurer of Service Provider’s performance.

Severability

  1. If any provision of these Terms and Conditions is held invalid, illegal, or unenforceable, the validity, legality, or enforceability of the remaining provisions shall in no way be affected or impaired thereby.

 

Promotional offer terms and conditions: 

*In consideration for your payment to Secure Home, the coverage period is for a twelve (12) month duration; and any promotions offered such as additional "free months" or "bonus months" are not part of the paid coverage duration. *In order to redeem any bonus months, you must make payment to renew the policy before the end of the original 12 month paid duration. The activation of the bonus months is solely contingent upon paying for the renewal of the policy before the expiration of the original term's paid duration, as bonus months will only become active if payment for renewal is received by Secure Home before the initial 12 month coverage period has been exhausted. *If the policy is not renewed within the original 12 month paid duration, the bonus months will become forfeit and void. In order to prevent lapse in coverage, and loss/forfeiture of bonus months, policy is subject to automatic renewal if payment for renewal is not received upon expiration of initial paid duration.

 *If the policy is renewed within the initial paid duration, the bonus months will become active on the last day of the 12 month coverage period, and will extend the coverage for the specified additional duration of any applicable bonus months; and the new paid duration (renewal) will begin following the expiration of the bonus months extended duration. 

*For example, a policy purchased on 1/1/2016 for 1 year + 2 free bonus months has a paid duration from 1/1/2016 thru 1/1/2017, and if the policy is renewed before 1/1/2017 then the 2 bonus months will become active from 01/02/2017 - 03/01/2017, and then the newly paid renewal duration will begin after the bonus months have been exhausted, which in this example would be from 3/02/2017 - 3/02/2018. *However, If the policy was not renewed by the end of the original 12 month coverage period by 1/1/2017, then the bonus months would be forfeit and void, and the last date of coverage would be 1/1/2017 which is the last day of the initial paid duration.

*We may modify these Terms and conditions at any time at the sole discretion on Secure Home, and each modification will be effective immediatly once notated on these Terms and conditions. You formally agree to accept any changes to the Terms and conditions through your continued use of the service.*
